Well this is very confusing.
What if a person files the I-140 after May 15th and his/her I-140 is approved. Later assume that I-485 date becomes current for that particular person (before Oct 2008), he/she files for the AOS/I-485 (before Oct 2008). While the I-485 petition is pending the date Oct 2008 comes what happens then? Will this nulify the filed I-140?

My labor was approved 8 months ago. Although i submitted all the documents to my attorney 5 months ago My employer is yet to file. the fact is i am eligible to file for 140/485/ead/ap. So now i am stuck. Will this affect me.Thanks in advance.:mad: :mad: :mad: :mad: :mad:

Gurus, my I-140 petition is pending due to Retrogression.Any idea what would be the scenario when the Pending cases at the Philadelphia Backlog Elimination Centre come through? what i am trying to find here is how many of these cases would be Pre June 2002 ?As per my research,majority of Cases at the Philadelphia centre are post June 2002.

A general question - Is it normal to see LUDs on the 485, approved 140, approved 765/131 a few (3) weeks after sending AC21/G28N documentation in?
I changed employers about a month ago (140 approved, 485 pending more than 180 days), and the new company filed AC21 on Nov 3. I saw a soft LUD on my 765, 131, 485, 140 yesterday (Nov 24) and another soft LUD on just my 485 today (Nov 25). I wonder if these have to do with the AC21 and G-28N updates or if it is a sign of I-140 revocation and I should expect a 485 denial soon?
Any response will be highly appreciated.

what matters more , IMHO, is some of the basic skills like motivation, hunger for goal, work ethic, stress management etc which typically is categorized as life skills. Which are not teachable.
Immigrants have these in plenty, that probably explains why a graduate from village school in India, can kick ass in a duke and later succeed at work too.
Education helps, quality education starts one off with advantage. But that's about it...life is marathon not a 4-6 year sprint @ universities.
These studies by wadhwa and co should start looking at these and not just patents , quality of education etc .

My address that they had on file was also an old one, from 2 years ago. I have since moved, and done the online AR15 thing and received my EAD at the new address, so I'm not sure why/how the system showed the old address.

I am guessing that your EAD was driven by the address which you provided while applying for it. CIS may not confirm what's on file, when there is already an address mentioned in application itself.

Hi,
I was following this thread and it has good information.
I have EB3 labor and I-140 approved with priority date March 2005. I couldn't file my I-485 in 2007.
Recently thru same employer I filed EB2 labor which got approved in Sept 2010. I have filed my I-140 under regular processing. I asked my attorney and he said as I already have one I-140 approved I should file this one under regular processing. USCIS might reject premium processing. Any advice.
My 6th year of H1-B is getting completed on Sept 2011.
Please suggest should I file my I-140 under premium processing? Should I try to convert it???

Ask your attorney and company if you can convert to premium and listen to them what they are saying. Based on their comments and input you can decide. As I-140 has to be supported by company we have nothing much to do except to request them. I wish you best of luck.

In this debate, it is important to consider what "America" really means:
It is not just tech. companies or the USCIS - it is every big, small and mid-size enterprise, school, hospital, university, firestation, state/federal govt etc. It is the local community in which we live, the neighbors we interact with, the folks at the check out counters, our children's daycare, and ofcourse it is our fellow American co-workers, supervisors and friends.
In the final cost & benefit analysis, I am just curious to understand how America stands to gain by preventing the free movement of high skilled labor and intellect across the country. How does it benefit by preventing individuals from getting a higher education or a promotion. It is already too late for most of us to give up at this stage of the process, so most of us will wait it out, and eventually get the green card. If it is going to be 5 yrs. from now, then why not now?
Perhaps the questions should be:
"What is America gaining by keeping high skilled individuals in this state of perpetual limbo"?
And
"What is the cost to America of giving out a Green Card to a high skilled immigrant whose petition to immigrate has been approved by the US govt.?"

If somebody is sending this letter, please do not send it without taking care of word-suggested corrections. There are too many green lines, most of the times because of spacing between two words.

Don't worry! EB-3 is supposed to be low-skilled so nobody is going to frown at grammatical or typographical errors. :)

IV core leadership has to change and so is the stratergy. Current Lobbying efforts have clearly not worked out. I call for elections to elect the new core team. All these conference calls and inaction is just wastage of time and things are getting worse. We need an aggressive stratergy and may need to take names and hit people openly to get our agenda pushed. IV leadership clearly lacks these skills.

HR 5882 has the answer for the FIFO problem.
USCIS is pretty good with approving cased based on PD for 3/4th of the year and in the last quarter they for the "Hail mary" play and DOS gives a wide PD range during the last quarter for USCIS to play. Apart from recapturing wasted visa's HR 5882 also has an automatic recapture provision to avoid any future visa wastage. If this provision is in place then UCSIS/DOS will not be in a position to playing the "some how use up visa by sep 31" card to approve random cases.
Rather than focusing on HR 5882 many are still pondering about LUD's and sill day dreaming. The demand for visa's is much higher than the supply of visa's, it doesn't matter what new spillover policy USCIS adopts, it can only provide incremental improvements. For a quantum improvment in the situation we need a legislation and HR 5882 is the best option we have now.

How many pending applications are there?
How many new ones accumulating every year?
Are there enough recaptured visas to cover all?
Agreed that with more visa numbers, and no potential threat to wastage of visa numbers, USCIS has no incentive nor tricky cards to play to justify their random approval bursts.....but will that be enough to prevent them from doing so, just because they can? I mean this is USCIS we are talking about.....Even with laws/memos/rules already in place, they are violating them left and right....
Whats to say that they won't try to reassure people that they don't have to worry about out of order processing because
- there are enough visa numbers for all.
- Though people may see delays, they will eventually all get their GCs
- Its faster and easier if they just grab the first box that is on the top of the pile, and approve cases from there rather than spending very limited resources they have to try to dig thru the boxes to find the cases with oldest PD.
- It will just be a minor inconveneince to the applicants...Their waiting times would drastically reduce from several years to only couple of years.
Would that be acceptable to us then?
