Hi
My wife has H1 approved. Currentlyy she is in India. Her H1B will start from October 1st. I had 2 questions:
1. For stamping does she have to wait till Oct 1st or she can go before also?
2. Based on question 1 if she can go before oct 1st and get visa, can she enter US before 1st october?

I'm trying to figure out how to make a 3d vector animation of a person walking or dancing. more specifically, the outline of a person walking/dancing.
I've seen this before on other sites, but can't remember where. sometimes it's the 3d outline animation, sometimes its asingle-color 2d animation. does that make sense. I'll try to post an example if I find one.
Anyway, does anyone know this process or know of a place that shows how it's done? thanks.

I had breakfast today with a few advocates and an Obama Administration official who noted that the immigration summit will now be held on June 25th. Encouraging. I also learned that the current expectation is that the immigration reform bill will likely start in the Senate and that Senator Reid is hoping for reform legislation to be considered in the fall.

Hi- When I started off with the green card process, I had not idea about what most of the things meant. I joined a very reputable Fortune 500 company in 2006 (the same year I came to the US on a H1B), and started my GC process in 2007. The company offered me an pre-approved labor with a 2006 PD, which had a matching requirement w.r.t job description and salary.
During July 2007, i filed for my I-140 and I-485. Subsequently, my I-140 got approved without any issues. Now, given that my priority date is close to being current (2/14/2006), I'm afraid if using a pre-approved labor will have any role to play with my I-485 approval.
And no, I'm not working for a consultant. And I have been with the same employer since 2006.

Will there be any chance to revoke or cancel approved i140 if we file 2nd i140 with same employer . My employer is willing to give approved labor which is better (EB2 ,PD-2003) than my labor (EB3, PD-2003) . But right now i am on 6th year . I got a 3 years H1B extension recently. If my first i140 canceled (??) how about my H1B . is it still valid?

July 2nd - Wife and I applied for 485\EAD\AP
The lawyer sent a single check(I know !!! I know !!!)
Our applications got separated.
Mine came back on Aug 30th and my wifes last week
We have now refiled
This time it has gone for "special handling"-bypassing the mail room
I haven't got the receipt yet
Anyone who had a similar experience or went via special handling for some other reason...
How long does it take to get the receipt nowadays ?
(I couldn't see any receipt update on USCIS- I guess most of the people are past that stage)
Will special-handling speed up my Receipt OR EAD OR AP?

I work for a big company. Each time when I move to a new project, my company ask me to file an LCA and H-1B amendment for new project location. It takes several month to get approval until then you have wait and face all travel restrictions.
I know that several smaller companies don�t file such amendments
Does anyone who why do we have to file such amendment?

I apologize for posting the totally un-related information for our IV cause but I think atleast some of us will be interested in another social cause happening back in India for the past year or so.

We all are affected by a number of social issues in our daily life and together we can be more stronger in dealing with them.
I felt sad for these kids (who started this campaign, most of them have returned back from US, for the only selfless purpose of changing the society) when I heard that they were attacked by hooligans. Let us provide them with some moral support, at the least.

is it possible and advisable to convert H1 B to H4 and go on searching for job and if find a job then coming back to H1? Are there any risks in this process? if so can some one explain me in detail?
Yes you can switch from H-1b to H4 status. later on when the prospective employer finds a new job for you then that they can file a change of status application from H4 to H-1b under non cap case.

Hi,
I was working for Company A with whom I've my H1 & I-94 valid until Aug 2010. But I was laid off from Company A in Dec 1st week and I found a new job with Company B in Jan 3rd week. So I was out of status for about 6 weeks time.
Now Company B don't wish to file a transfer but instead they are filing something called H1 "Loose Petition", obviously I'm not going to start work with Company B until this H1 gets approved and I travel out of US, get restamped based on my New H1 petition, come back to US and start work for Company B.
But my question is, while from today until this so called "Loose Petition" H1 is getting processed (since they applied premium it would take about 2-3 weeks) can I legally stay in US (in terms of I-94 I've my I-94 from Company A H1 which is valid until Aug 2010)?
My employer suggest that I stay here until H1 processing result comes out and then leave country get restamped. Please let me know if you have an Answer.

Supposed my I-485 was approved, am I legally required to go to USCIS, surrender my I-94 card and get a I-551 stamp? Could I just wait for GC to come in the mail?
The card is taking just a few days to arrive these days. Just wait for a few more days. You need the I-485 approval notice to get I-551 stamp.
But I'm sure you won't need it.

Is there any difference in timline to file a GC for sibling in "Family member of a permanent resident in a preference category" AND "Family Member of a U.S. Citizen in a Preference Category".
I am a GC holder right now and would like know, if I should wait to become Citizen or file GC for my sibling now.

Hello,
I 'm on H1-B visa already max out and got the extension for 7 th year based on perm pending.
Petition is going to expire in Sep 2011 and last week my perm got denied.
My employer is going to appeal for the perm and also going to apply H1B extension.
Also I got an offer from other employer waited long time for this exiting offer. Not sure what are my options now , is it possible to take the new opportunity or should I stick with my current employer to deal with this issue?
Looking for suggestions ASAP , thanks

I sent my EAD application on 10/24(Wednesday), reached NSC on 10/26(Friday), Notice date 10/29(Monday), Check cashed 10/30(Tuesday)..Already got I-485 receipts back in August.
So they are Current now.... But what about those July/Aug filers who are still waiting for their receipts? Very unfair to them. I could wait for 2 months to get my EAD receipt if they could first receipt all july august filers...
They are really unpredictable..
