Guys, I need ur suggestion and experiences on my typical situation
I am in the process of going full time with my client.
I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.
my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.
My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.
Was anybody in a similar situation ?
I don't want to take a risk by using EAD and my wife loosing H4 status.
Please advice

Hi,
I'm currently on my amlost 6th year of my H1B. I have my i-140 (Still valid) approved from my previous employer under EB3. I'm applying for a new PERM with my current employer and I would want to apply in EB2. I hold 3ys bachelor's degree with 12 yrs of experience. My attorney says that chances are either my PERM or I-140 will be denied based on my education qualification.
I'm looking for your advice on the following.
1) I heard that I can apply for 3yr extn based on my previous I-140. Considering that is it worth the fight on EB2. I'm looking to port my PD (Nov 2008) to this I140 if approved.
2) My company sponsers two PERM to be applied, so it is worth to try for EB2 and later if denied on EB3. Will this affect my H1B extensions? say if it's get rejected on EB2, am I not eligible to apply for H1B extension with my current employer, since my labor/i-140 is denied.

I am a July filer and have the option of working for a reputable company as expert consultant for 6 months (initial offer). Yates memo indicates that self-employment is possible. Here is my question: Do we need to register a company to be considered self-employed? As a consultant you may not have a customer for while. Isn't it better to register a company if you want to claim self employment? What are the pros and cons of registering a company?

Called IV, But the person who answered was busy answering similar questions from other member.We don't want to waste precious time of IV leaders by calling indvidualy.
If someone who attended can summarize for the benifit of those who missed, It would be great.
Also does members of other nationalities(non Indians) also attended the conference call.. Hopefully IV is striving to become voice of all EB GC aspirants. Everyone will gain from joint effort and IV will have resources to do meaningful things.

My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009
In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time
Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.
What are the best options for H1B refiling case
in case if it is denied, will it super impose the original H1B approval ?
is it good idea to cancel/revoke pending H1B refiling case ?

Just Received a copy of my ETA 7089 from my HR. I learned that my Labor Cert may not have been properly filed.
The experience column
H6 - Is experience required in the job offered required for the JOB?
is NO
H14 - Specific Skills or other requirements says:
Qualifications include:
1) Five years of experience in Web Development ... and so on
H14 and H6 Contradict themselves...
My HR is dumb and the attorney had made mistakes for simple H1b filings in the past..
Any help/suggestions will be appreciated!
