Hi
My friend was on H1B visa from last 5.5 years and Laid off last week .
I want to know what options she has to stay in USA.
from last company her labor and 140 was approved .
Can she do visa transfer and start new labor ?
Its only 5-6 months left in her 6 year h1b visa .
Attorneys please reply .

I know this issue is still a grey area and certainly no one seems to know a concrete answer to this.
If i have my H-1 Visa and EAD as well. Can i continue to Work on my H1-visa for the primary employer and take up a part-time job with the EAD.
I have hear ppl say that H1 becomes void once EAD is used. Is there any kind of document advocating this? I have not seen any. Lawyers have conflicting opinoin. Has anyone thought about this. I have decided to take an infopass appointment and ask the IO to show me a document that states that H1-becomes void or The other way around.
Can anyone shed more light in to this. Thanks

I know my dates are current and i want to know how to
- Take infopass appointment?
- Does it has any affect on my 485?
- What are the things we can ask in Infopass appointment.
Did you sent the HIGH FIVE to IV?

Companies can change their address after filing your 485 and there is no reason to intimate USCIS if the company's address change. BUT make sure your address is correct on their system. THIS IS VERY IMPORTANT

you can claim him if:
1) He didn't earn more than $3500 in 2010
2) You have proof of providing more than 50% of his expenses (ie. paid his tuition etc.)
3) He was in the US for more than 180 days in 2010 (ie. US resident for tax purposes)
If you paid for his tuition, you may be able to claim tuition credits for him too.

When an h1b transfer via regualr processing (california center) is pending...and say the person gets fired /layed off etc....
Can another h1b transfer be done with just the recepit notice and previous I-797?
What's the risk? Some companies are not willing to do premium processing even if the candidate is ready to pay the premium process fee.

In the early 1960s, President Eisenhower worked with the Catholic Church to airlift 14,000+ unaccompanied minors from Cuba to America in an effort called Operation Pedro Pan. In a similar effort, President Obama is working with the Catholic Church to possibly airlift thousands of orphans from Haiti and allow them to remain in the US in a humanitarian parole status. Obviously, this will be a huge challenge and it is always a difficult decision to remove children from their homeland, but the future for orphans in Haiti seems very grim.

I filed my I-485 and I-140 together in July 2007 using substitute labor (priority date) in Eb3 category.
I have Master degree, so can I change my category from EB3 to EB2 and keep the same priority date?

10 year visitor visa. They visited few years back. They want to visit again this year. Do I need to send any documents? (letter to IO or affidavit of support or anything?)

U must be fine, but you may just want to give a letter to them staating your current address and contact information, in case they need to fill out thei 94 forms and need accurate info. Its your choice :)

Animal portraits are my "thing", so I don't mean to be overcritical... Try to get the animal's face in the light. The rooster's a good subject, and you got down to rooster height, which is really good, and you got him when crowing - a great behavior. Unfortunately, the face is in shadow, and that means you don't get the "catchlight" sparkle in the eye. Also, you often don't get the eye quite in focus, since autofocus works on contrast. A lot of faults in a protrait can be overlooked if the eye is sharp. In this case, you're focused on the neck feathers, not quite on the eye, so if you can reshoot it, try for getting light in the eye, and I think you'll like the results even more. Good luck & have fun with it!
