I am a july 2nd filer , still waiting for EAD for my spouse .I have got mine a week ago,but her case status has no change. When we call 1-800-375-5283 it says there is no information for this case, however we are able to check the case status online, which says received on October 15, and its still pending.
Another issue is they did not honor the received date.
Is there any one in similar situation?
What can we do at this point? Will Infopass appointment or contacting ombudsman help?

My country of citizenship is Canada and currently working on TN status. Canada is covered under Visa waiver program so, I don't need to get visa stamping but need to travel through a POE so, I could get new I-94 for the H validity period.
In the I-129, I have opted for Calgary as POE, but due to some reasons now I have to travel via Toronto, would that be ok?

Fellow IVians,
We need to contact the campaigns of Senator Obama and Senator McCain and apprise them of our core issue. We all know that some relief bills are on the House's agenda but then given the actual time the Congress is going to be doing any legislative business, it is time to be prepared for the next presidency.
We can convey to both the campaigns that we are a 25000 strong High Skilled Immigrants advocacy group and can donate/campaign/put forward their case for them in this election.
A formal open letter to both the campaigns can be send as a start and then liaisons for immigration purposes can be contacted demanding their position about our issue.
I know that there is a stray mention of immigration related issues on the official website of both campaigns but if we can eke out something concrete regarding policy change and its implementation within a certain time frame after the elections it would be very helpful for our cause.

Hi,
I know that this is not a "Green card related" question but an important question that I hope someone will answer. I am planning to use EAD after my I140 approval and jump to consulting business. I have thought about Self-employment but it sounds like it is risky. Are there any good consulting companies which charge very less percentage for having me as an employee on EAD. I hope that company can send AC21 and continue my GC processing.
Thanks,

MALDEF, the American Civil Liberties Union, the ACLU of Arizona and the National Immigration Law Center (NILC) have announced that they will hold a news conference tomorrow morning on the steps of the State Capitol in Phoenix to announce they will sue to overturn SB1070. The groups will challenge the law on constitutional grounds.

Hello fellow IV'ans.....
Based on the volume trend shown in the USCIS website I called them and wanted to know whether my case has been pre-adjudicated or not?
Obviously I got the standard answer from the customer service saying the case is pending, I pressed on the fact that I needed to know (based on their website's information) whether the case is pre-adjudicated or not.
The customer Service rep. then forwarded the call to the National Service Center where an officer picked up the call and said "as of September, 02 2009 the case is in the Pre-Decision Unit and that they will decide on the case, but still at TSC.
I am a little confused  coz haven't heard anything, anywhere, anyone talking about case being in the Pre-Decision stage. Your esteemed thoughts please....

I am currently in my 6th year of H1-B. I started working for my current company on H1-b work visa in June 2010. As my 6 year visa period expires in June 2011, I need to apply for a H1-b extension (based on I-140 approval) pretty soon. My employer had paid the $1500 ACWIA fee recently i.e. 8 months ago, when they filed for my H1-b the first time. Next month, when they apply for an extension of my H1, do they have to pay the $1500 ACWIA fee again?
In I-129 instructions, it specifies that one of the exemptions for paying the ACWIA fee is "second or subsequent extension...". Would my case be considered a subsequent or second extension?
I would greatly appreciate your response.
Thanks much.

Hi,
My PD is Dec-04 and I-485 filing date is Sept-07.
I changed my job in Aug-2008 and discontinued my H1B which is expired in Sept-2008. Now my only legal status is 'adjustment of status from H1B to Permanent Resident'. I think this is very common state most of the people waiting looong for GC fall into.
Now, I saw one of my friend's i-485 denied (with NO option to reopen!) bcoz an approved I-140 was not attached to this application. I agree that this is not simple mistake for USCIS can ignore, but there is always a 'very very remote' possibility that every application can be quetioned due to some flows in the filing.
Here is my question: Since I discontinued my H1B status and I am still in this country, can I apply for a fresh H1B? I am thinking because H1B quota is still open this year and to face any unexpected reason for 485 denial!
thanks in advance!

I am currently on H1B through company A previously I was working for Company B before that was working for Company C.
I transferred my H1B from C->B->A, Because of current Economy now my employer(Company C) is saying that if I lose my current project at client location he is going to cancel my H1.
If that happens can I go back to B Or C company, as My previous companies never cancelled my H1.
Appreciate any help here.
Thanks.

My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?
I will appreciate any advice.

When we file 485 AOS along with EAD & APL, these are three seperate forms, so we get three seperate receipt numbers?
is that correct?
What abt 485 for wife? is that also another receipt notice?

A Department of Homeland Security Office of Inspector General report has been released which paints a very troubling picture of the 287(g) program which allows local and state law enforcement agencies to enforce immigration laws. The report doesn't mince words:We observed instances in which Immigration and Customs Enforcement and participating law enforcement agencies were not operating in compliance with the terms of the agreements. We also noted several areas in which Immigration and Customs Enforcement had not instituted controls to promote effective program operations and address related risks. Immigration and Customs Enforcement needs to (1) establish appropriate performance measures and...

My friend John Lamb in Nashville has had this idea for a while. It sounds a little nuts at first, but as John notes - Giving American citizens the power of granting legal status to their foreign-born friends is an idea I've had for a while but not trumpeted very much. The idea is, if deputization of immigration enforcement responsibilities is such a great idea, why not deputize the admission and naturalization piece, as well?. Well now a Utah Republican Senator is proposing a bill that would do just this. According to the Salt Lake Tribune: Rep. John Dougall, R-Highland,...

Hi
I fall in Schedule A which is going to retrogression begining Nov, 06.
I am on H4, meanwhile i just made it to file my I140, 485, 765 and AP concurenntly, hence will get my EAD, but no approved 485. My situation is I dont want to be with this employer for long for this is in upstate MI, where my spouse wont be able to continue the H1, hence we will be living seperate for sometime.
Now after my 140 approval and 485 pending for 6 months can i change the employer, I heard something with AC 21 you can. But what are the pros and cons with it.
Can my employer revoke the approved 140 after 6 months too.

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. That's roughly the typical weekly usage we saw last year and if the pace doesn't change much, the cap will potentially be hit one to two months later than for FY2011. Later this summer as the cap starts to get a little closer to...
