    Keep new approved H1 and all related documents with you for POE, also EVL.

    I enered POE twice in similar situation as yours without new stamping.
    Both times POE (Atlanta) experience was good for me.

    I just entered even after new USCIS memo.

    Hi All,

    I would like to apply my 9th year H1B transfer with new employer based on my Labor which is pending for more than 365 days with my Current Employer. The proofs which I got from my current Employer are

    1. Certified mail receipts showing the date my documents were received by the Labor Department.

    2. Fax received on year 2004 from Labor Department which shows list of employees for whom they filed labor via my current company. This contains my name, case number and priority date.

    3. Based on this pending Labor I got last year extension with my current employer.

    4. Labor documents which they sent DOL.

    Would this information be sufficient and helpful to file H1B transfer for me? Or Do you need any other information to do H1B Transfer? If so please let me know In which ways I can get the information other than my Employer. My employer will not cooperate with me in this issue.

    Due to the big mess of July visa bulliten. Can I file multiple 485 cases to secure that one of my AOS case is accepted? Since once it is rejected due to improper filing, the next visa bulliten would be back to 2006 or 2005.
    My situation is:

    First I-485 case: I can file I-485 as principle applicant, and my spouse can file as dependent
    plan to submit at the end of this week (Aug 11, 07).

    Sencond I-485 case: My spouse can file as principle applicant based on his I-140, and I can file as dependent, plan to submit before Aug 17, 2007, with cover letter stating:
    If the first AOS case based on xxx's I-140 is accepted, please withdraw the second AOS case based on YYY's I-140.

    Is it doable? any potential issue? Thank you very much for your comments and advise. Urgent!!!

    Hi, My name is Alex and I am a Permanent Resident for 4 years. I got married but my wife just have a turist visa B-1. So, I already applyed for her filling I-130. What is the next step? Just wait or can i fill out I-765 because she needs to work?... One more question...She still have I-94 valid for 6 months, does she need to go back to Brazil?

    Dallas-Fort Worth Immigration Lawyer Has Just Posted the Following:
    U Visas: extended until February 1, 2010.

    U.S. Citizenship and Immigration Services (USCIS) extended the filing deadline for temporary benefits of the U Non-immigrant Interim Relief Program. The temporary benefits program was set to expire December 31, 2009 but has been recently extended until February 1, 2010.

    H-1C Visas: expired December 21, 2009

    USCIS accepted H-1C non-immigrant temporary workers petitions expired December 21, 2009. The H-1C classification authorized up to 500 nurses annually to work in eligible health care facilities. Although the visa classification expired, nurses currently in H-1C status will not be affected.

    They might increase the no. of H1Bs but might not do any refinement in the immigration process I guess.:o

    Hi,

    My 6 yr H1B expires Dec 15,2009. I had applied for labor in 2008 and have received the case number for the labor dated June 26, 2008. My labor is not yet approved and online the status shows "pending". The company has not got any RFE against the labor. I dont know why its taking so much time. My main concern is, Can I apply for h1B extension on the basis of "Pending" Labor approval. What is the time frame to apply for an H1B extension? How long is the extension granted for ? 1 yr or 3 yrs....

    Please advise ....

    The I-131 Form update date shown by NSC is 10/18, whereas many of the folks are still awaiting their AP's...and even Texas says I-131 processing date current....So how come majority of them still waiting for AP ??

    I would appreciate some feedback on following situation;

    1) My wife is on H4/EAD. She is beneficiary of my AOS application. She holds Master's Degree from US. What is the best option for her to work on?

    2) She was on H1B from Oct 2001 to Mar 2003. She COS to H4 after her job terminated with-in weeks. Since then she's been in US (on H4) and never been out for more than couple of months. Can she apply for H1B and not limited to H1B quota and wait till Oct?

    3) Would changing to H1B abondon her AOS?

    4) Can she work on EAD now and switch to H1B around Oct time if she has to apply for fresh H1B for next yr quota.

    4) If she can get H1B, can she still use AP for travel?

    6) If i loose job or my 485 is denied, isn't it better she has H1B so i can get on H4 or on her GC application.
