My H1B was refused under section 221(g) (petitioner is not able or willing to provide employment....) and case has reached USCIS for review. The lawyers however are asking me to travel on H4 and then convert to H1 in US and they say this can be done in 2 weeks. I am so very skeptical about this! How is this even possible?
Their response is that i have an H1B from earlier quota, so i can get a new petition filed and start working on it once its approved.How come people dont do this if its valid?
My questions if anybody can help me are
1) Can i go on H4 visa without revoking my H1B petition which is under review with USCIS? Or will consulate ask me to revoke my H1B petition?
2) If i go on H4, can i really get a COS to H1 in US i.e. not the April 2011 quota but in the already assigned quota and i can start working within a few days of approval?

Pictures are listed in required list of documents but they don't ask for them always. My wife went for stamping 4 months back and they just looked at marriage-certificate and my approved petition....that's it ! But I have seen CO's asking for pics.
So it's a hit/miss kinda deal....

Hey HybridIllusion,
It all depends on what format your 2d image is in. If it is in AI or EPS, you can automatically import the image into Swift 3D and animate it. If it is a JPG or GIF, you might have a few more steps before importing into Swift 3D.
Take your image and import it into Flash. Export the Flash animation as AI (adobe illustrator) by going to File | Publish Settings | File Types tab. Check the AI box and then publish the movie. The image will be exported in the AI format. From the AI format, you can import into Swift 3D and animate with no limitations.

We are among the July filers. TSC applications went to VSC and back to TSC. My wife and I both got our EADs. Social Sceurity office told my wife that her A# is bringing up someone else's data. We went to Infopass, but it was of no help and we were adviced to contact or write to TSC. We placed a service request by calling the national phone number. That was more than two weeks back. Nothing has happened yet. All three applications - 485, EAD, AP has the same wrong A#. Her EAD is of no value without the correct A# that has to be rectified at the 485 stage and then EAD. Any suggestions?

I'm currently moving back to Northern Idaho and am trying to finally get my foot in the door as a photographer. Basically I've emailed some companies asking about the need for a part/full time photographer. Of course, they are all interested in sample shots (not a problem) and rates :confused:. I don't know what to say on the rates part. I've searched through the old threads, but didn't see any. Roughly, what is a normal rate? Keep in mind It's not a huge city (pop. 32,000,not including surrounding areas).

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?

Can I count part time experience obtained before my Bachelors degree for an EB2 petition?
I have 2.5 years of part time experience, can we use this and apply with MBA+1 requirements?

Fancy meeting you here, dohko! The experience at half time can be counted to be 1/2 time itself - i.e. 2 years under 20 hrs./week = 1 yr. full time.
Your experience however has to be obtained AFTER your Bachelor's degree.

Has anyone been in a situation where they joined a new employer after having completed 180 days after 485-filing, and sent in AC-21 documentation through an attorney?
If so, which attorney did you choose for the AC-21 paperwork?
- The old attorney, that represented you and your ex-employer, and filed your labor, 140, 485, EAD, AP
- or the attorney representing the new company
- or a third attorney that you went and found on your own
What do you think is the best way to go, if there is a best way to go?

Does the published cumulative demand data represent
a) all pending 485 cases that include primary applicants and their dependents
OR
b) all pending 485 cases that include primary applicants only?
If say, the demand data for EB3, till 2004 says 35,000 - does this mean there are a total of 35,000 pending cases in total OR does this represent primary applicants only?
If it represents primary applicants only, what is the multiplication factor we need to use to get an approximate number for total pending 485 cases?

I was laid off in Dec 2009, but severance will stop till early Feb. Now I found two potential jobs. Company A is a corporation in same state, but company B is a university in some other State.
1. How long will take them to transfer my H1B? does the different States matter on this transfer time? I want to make sure which one can submit the H1B transfer before my paycheck stops in Feb.
2. In order to apply for Green Card later, which job is better for Green Card application? I heard university will not help the staff (accountant) for Green Card application. Is that true?
