Hello
I'm A medical student who has come to do a 1 month internship(Clinical Elective) at a University on a F-1 visa valid till mid may 2009 .My internship here ends at the end of march. I have also 2 internships(cliinical electives) scheduled for the month of May and June as well at ANother University . The main problem is that the other univ require me to be on a B-1 and not on a F-1 . My present school has called them and requested them but they rejected the plea. They want me on B-1 . Now my question is that "Can I change my status from a F-1 to a B-1 while in US" - I have a valid visa which is not yet expired .

It would be appreciated if u can tell me about the forms that I shall need to fill in for the same ? Do I need to hire an attorney for it ?

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Hi All,

My Green card Priority date is April 2004 under EB3 category.
I-140 was approved 1yr back and I-485 applied in August 2007.

Where to check the current processing dates and when will we receive Green card?

Any idea still howmuch time will it take to get GC for the people with above PD date?

Do i need to check the URL https://egov.uscis.gov/cris/jsps/ptimes.jsp?

I think we need to expose employers who are taking advantage of us in different ways just because we are stuck with them due to retrogression. This way if we cannot change the legislation right away we can atleast scare the crooks by exposing them so that they cannot trap new people.

Hello, I really appreciate a lot if anyone here could help me on this..

The company I have been working with an H1B for a years got recently restructured to a new firm and it filed a H1B transfer for me this Feb. The petition got an RFE and the firm made an Appeal, which is now pending. The job looks now rather unsecure and I am not sure if the company will continue sponsoring me for a new H1B if this transfer got denied in the worst case scenario..

So my questions are:

1. Can I file a COS to F-1 while my H1B transfer appeal is still pending?

2. If my H1B transfer appeal got rejected, or I got laid off while it's still pending, after that happened is it still possible and in time to file a COS to F1?

I am really worried about my current situation now, and thank you very much if you could kindly help on it!

Hi,

I was working for Company A with whom I've my H1 & I-94 valid until Aug 2010. But I was laid off from Company A in Dec 1st week and I found a new job with Company B in Jan 3rd week. So I was out of status for about 6 weeks time.

Now Company B don't wish to file a transfer but instead they are filing something called H1 "Loose Petition", obviously I'm not going to start work with Company B until this H1 gets approved and I travel out of US, get restamped based on my New H1 petition, come back to US and start work for Company B.

But my question is, while from today until this so called "Loose Petition" H1 is getting processed (since they applied premium it would take about 2-3 weeks) can I legally stay in US (in terms of I-94 I've my I-94 from Company A H1 which is valid until Aug 2010)?

My employer suggest that I stay here until H1 processing result comes out and then leave country get restamped. Please let me know if you have an Answer.

I know that most of the people on this forum are EB filers. However, for the few stragglers here who are filing in the family based category, please share your experience on filing the I-751 (petition to remove the condition on the GC). Specifically, I'd like to know the following:

- Estimated time from filing date to receipt of permanent GC
- Did you have interview with USCIS?
- Compare / contrast with first interview during the AOS process.

Hi everyone,

I have just received my H1-B, and I'm planning on a two week vacation back to my country.

I'm not on a good relationship with my company at the moment, and even if they granted my vacation, I'm afraid they might cancel my H1-B visa while I'm on a vacation overseas.

If they do, would I be not able to come back into US, or would they at least give me a few days to pack up my stuff?

Any advice and comments would be appreciated.
